1. Acceptable Use

You agree to use our Services only for lawful purposes and in a manner consistent with these Terms. You are prohibited from using our Services to engage in or promote any of the following activities:

  • Pornographic Content: The creation, distribution, or sharing of explicit, pornographic, or sexually explicit content is strictly prohibited. This includes any form of adult content, sexually suggestive material, or material that promotes sexual services.

  • Harmful or Abusive Content: You may not post, upload, or distribute content that:

    • Promotes violence, abuse, or harassment.
    • Contains hate speech, threats, or discriminatory language.
    • Encourages self-harm, suicide, or any illegal activities.
    • Is intended to harm others physically, emotionally, or psychologically.
  • Political Activities: The use of our Services for political campaigning, lobbying, or the promotion of political agendas is strictly prohibited. This includes, but is not limited to:

    • Posting or sharing content that promotes political parties, candidates, or movements.
    • Distributing propaganda, misleading information, or content that attempts to influence political outcomes.
  • Gambling and Betting: The use of our Services to operate, promote, or facilitate gambling or betting activities is strictly prohibited. This includes, but is not limited to:

    • Advertising or promoting online casinos, sports betting platforms, or any other gambling services.
    • Operating or sharing referral links, affiliate content, or promotional material related to gambling.
    • Distributing content that encourages or normalizes gambling behavior.
  • Illegal Activities: You may not use our Services to engage in or promote any illegal activity, including but not limited to:

    • Fraud, money laundering, or any form of financial crime.
    • The sale or distribution of illegal substances, including drugs or counterfeit products.
    • Copyright infringement, including unauthorized sharing of copyrighted content.
  • Malicious Content: You may not upload or share content that:

    • Contains viruses, malware, or any software that damages, interferes with, or disrupts the Services or any third-party systems.
    • Attempts to compromise or bypass security features, including hacking or phishing.
  • Impersonation and Fraud: You may not impersonate another person, entity, or organization through our Services. Fraudulent behavior, including the use of false identities or the spreading of misinformation, is prohibited.

2. Messaging and Communication Policies

  • Appropriate Use: Messaging services (including WhatsApp, and other platforms) provided by Bread Crumbs are intended for legitimate communication purposes. Using these services to share or distribute prohibited content (e.g., pornography, harmful materials, political propaganda, or illegal activities) is prohibited.

  • Reporting Abuse: If you encounter any content or behavior that violates these Terms, you are encouraged to report it immediately to our support team at [email protected]. We will investigate reports and take appropriate action, including blocking, suspending, or terminating access to our Services.

  • No Spam or Unsolicited Communication: Sending unsolicited marketing messages, spam, or harassment through our messaging platforms is prohibited. This includes bulk messages, promotional content without consent, and unsolicited requests for financial assistance.

3. Enforcement and Consequences

  • Violation of Terms: If you violate these Terms, we reserve the right to take actions that may include:

    • Removal of content or messages that violate these Terms.
    • Temporary or permanent suspension of your access to messaging services, or other parts of the Services.
    • Reporting violations to relevant authorities, if necessary.
  • Monitoring and Moderation: We may monitor the use of our Services, including the content uploaded and messages exchanged through our platforms, to ensure compliance with these Terms. We reserve the right to take any necessary actions, including blocking content or users, without prior notice.

4. User Responsibilities

As a user of our Services, you are responsible for:

  • Ensuring that all content you upload, share, or transmit complies with these Terms and applicable laws.
  • Reporting any violations of these Terms to [email protected].
  • Refraining from using our Services for any prohibited activities as outlined in these Terms.

5. AI Agent Services

Bread Crumbs offers AI-powered agent features as part of its Services. By using these features, you agree to the following terms:

Nature of AI Responses: The AI agent is designed to assist with automated communication and customer engagement. Responses generated by the AI agent are based on the information and instructions you provide. Bread Crumbs does not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.

Your Responsibility for AI Output: You are solely responsible for reviewing, approving, and ensuring that any content generated or distributed by the AI agent on your behalf complies with these Terms, applicable laws, and the policies of any third-party messaging platform used through our Services. Bread Crumbs is not liable for any harm, loss, or legal consequences arising from AI-generated content sent under your account.

Prohibited Use of AI Features: You may not use the AI agent to:

  • Generate or distribute any content prohibited under Section 1 of these Terms.
  • Impersonate individuals, organizations, or entities in a misleading or harmful manner.
  • Conduct automated interactions intended to deceive, manipulate, or defraud end users.
  • Violate the terms of service of any third-party messaging platform integrated with our Services.

Data and Privacy: Interactions with the AI agent may be processed and stored to improve the quality and performance of our Services. By using the AI agent features, you consent to this processing in accordance with our Privacy Policy.

AI Limitations: The AI agent operates based on the instructions, templates, and data you configure. Bread Crumbs is not responsible for unintended outputs resulting from incomplete, inaccurate, or ambiguous instructions provided by you.

Suspension of AI Features: We reserve the right to suspend or restrict access to AI agent features if we determine, at our sole discretion, that these features are being used in violation of these Terms or in a manner that poses a risk to users, third parties, or our Services.

6. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate account, billing, and contact information and to keep that information up to date.

You are responsible for configuring your messaging channels, AI agents, templates, automations, and integrations correctly. You must ensure that your use of the Services complies with applicable laws, these Terms, our Privacy Policy, and any third-party platform rules that apply to your communications.

7. Payments and Subscriptions

Some Services require payment through a subscription, paid plan, usage-based charge, one-time fee, or other paid arrangement. By purchasing a paid Service, you authorize us or our payment processor to charge the payment method you provide for all applicable fees, taxes, renewals, and other charges.

Subscription fees are billed in advance for the applicable billing cycle unless stated otherwise. Usage-based fees, if any, may be billed based on the usage recorded in your account or according to the pricing terms presented at checkout or in your plan details.

You are responsible for all taxes, bank fees, currency conversion charges, and payment processing fees that apply to your purchase, except for taxes based on our income. If a payment fails, we may suspend or limit access to paid Services until the outstanding amount is paid.

We may update our pricing or plan features from time to time. If a pricing change affects an active subscription, we will provide notice before the change takes effect where required by applicable law.

8. Cancellations and Plan Changes

You may cancel your subscription through your workspace settings. Cancellation stops future renewals but does not automatically refund fees already paid.

After cancellation, you will retain access to the paid Services until the end of the current billing cycle unless your account is suspended or terminated for violation of these Terms. We may allow upgrades, downgrades, or plan changes, and any resulting fees or credits will be handled according to the plan terms presented at the time of the change.

9. Third-Party Platforms and Integrations

Our Services may depend on or integrate with third-party platforms, including WhatsApp, payment processors, hosting providers, analytics providers, and AI service providers. Your use of those third-party services may be subject to separate terms, policies, fees, availability limits, approval processes, rate limits, and compliance requirements.

Bread Crumbs is not responsible for interruptions, restrictions, rejected templates, account limitations, policy enforcement, or changes made by third-party platforms. You are responsible for ensuring that your content, campaigns, automations, and messaging practices comply with the rules of each third-party platform you use through the Services.

10. Intellectual Property

Bread Crumbs and its licensors own all rights, title, and interest in the Services, including software, product features, interfaces, workflows, designs, documentation, branding, and related intellectual property. These Terms do not transfer ownership of the Services or our intellectual property to you.

You retain ownership of the content, data, message templates, prompts, instructions, and materials you submit to or configure within the Services. You grant Bread Crumbs a limited, worldwide, non-exclusive license to host, process, transmit, display, and use that content only as needed to provide, secure, support, and improve the Services and to comply with legal or contractual obligations.

You may not copy, modify, reverse engineer, resell, sublicense, or create derivative works from the Services except as expressly allowed by law or with our written permission.

11. Termination and Suspension

You may stop using the Services at any time. We may suspend or terminate your access to the Services if we reasonably believe that:

  • You violated these Terms, our Privacy Policy, applicable law, or third-party platform policies.
  • Your use of the Services creates security, legal, reputational, operational, or financial risk.
  • Your payment is overdue or cannot be processed.
  • Continued access is required to be restricted by law, a regulator, or a third-party platform.

Where reasonable, we will provide notice before suspension or termination. However, we may act without prior notice when immediate action is needed to protect the Services, users, third parties, or legal compliance.

Upon termination, your right to access the Services will end. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability, dispute resolution, and data retention obligations, will continue to apply.

12. Warranty Disclaimer

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Bread Crumbs disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.

We do not guarantee that the Services, third-party integrations, AI-generated outputs, messaging delivery, template approvals, analytics, or content moderation will be accurate, complete, uninterrupted, secure, or suitable for your specific use case.

13. Limitation of Liability

Bread Crumbs is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Services, including but not limited to the transmission of prohibited content or the actions of other users. While we take reasonable steps to moderate content, we cannot guarantee that all prohibited content will be identified or removed.

To the maximum extent permitted by law, Bread Crumbs will not be liable for lost profits, lost revenue, lost data, business interruption, reputational harm, or any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services, even if we have been advised of the possibility of such damages.

14. Refund Policy

At Bread Crumbs, we strive to provide our customers with a high-quality service. We understand that circumstances can change, and you may need a refund. Please review our refund policy below.

Refund Eligibility

Refunds may be requested under the following conditions:

  • Refunds for paid plans are available within 7 days of the initial payment or renewal. If you are not satisfied with the service, you may request a refund within this period.
  • Refunds may be declined if the account has used a significant portion of the paid plan during the refund window. As a guideline, this means usage exceeding 25% of the conversations, credits, or other usage allowance included in the purchased plan for that billing period.

Refund Process

To request a refund, please contact our customer support team at [email protected] or through the WhatsApp contact link on our website within 7 days of the initial payment or renewal. Provide your account details, the reason for the refund request, and any other relevant information.

Once we receive your request, we will process it within 5 business days. If your refund is approved, the amount will be credited back to the original payment method.

Non-Refundable Items

Refunds are not provided for the following:

  • Payments made after the refund eligibility period has passed.
  • Usage beyond the refund window.
  • Custom development or setup fees, or other one-time charges associated with special requests.

Cancellations

If you choose to cancel your subscription after the refund window has passed, you will retain access to the service until the end of the current billing cycle. No further charges will occur after cancellation.

Changes to the Refund Policy

We reserve the right to modify or update this refund policy at any time. Any changes will be communicated to users via email or through a notice on our website.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law rules, unless applicable consumer protection laws require otherwise. The Services are operated by BREAD CRUMBS YAZILIM TEKNOLOJİ HİZMETLERİ DIŞ TİCARET LİMİTED ŞİRKETİ, operating from Istanbul, Turkey.

Before starting a formal legal claim, you agree to contact us at [email protected] and try to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue the dispute in the courts or forums that have legal authority over the matter.

Nothing in this section limits either party's right to seek urgent injunctive or equitable relief where necessary to protect intellectual property, confidential information, security, or service integrity.
